General terms and conditions

 

1. Validity

 

These terms and conditions (GTC) are applicable for all deliveries from Audictive to consumers (§ 13 German Civil Code). The consumer is defined as the individual person who concludes a legal transaction for a purpose which cannot be attributed to his / her commercial or independent professional activity.

 

2. Contractual partner

3. Offer and contract conclusion

 

3.1 The presentation of the products in the online shop does not represent a legally binding offer, but is merely a non-binding online catalogue.

3.2 By clicking the button „I confirm my order“, you place a binding order for the listed articles on the order page. The contract of sale becomes effective if we accept your order immediately after receipt of your order by email confirmation.

 

4. Right of revocation

Right of revocation Germany

 

You may revoke your declaration of intent within two weeks in textual form (e.g. letter, fax, email) without indicating any reasons or by returning the respective goods. The grace period for revocation begins earliest upon receipt of the goods and this notification by the recipient (in case of recurring deliveries of the same type of goods not before receiving the first partial delivery). The timely dispatch of the revocation or the goods is deemed to be sufficient for compliance with the revocation term. Please submit your revocation to:

Consequences of revocation

 

In the event of effective revocation, the services received by either party have to be returned and any benefits that may have been accrued have to be released. Should you not be able to return the goods or only return them partially or in a deteriorated condition, then you will be obligated to value replacement. In the case of goods surrendered this does not apply if the deterioration of the goods is brought about solely by a tryout thereof - such as would have been possible for you e.g. in a retail shop. Apart from that, you may avoid any duty to provide compensation for any deterioration of the goods caused by the intended use, by not using the goods as your own property and refraining from all actions that may affect its value. Items able to be sent in a package are to be returned at our expense and risk. Items not able to be sent in a package will be picked up. Obligations to refund payments must be met within 30 days. The term starts for you with the sending of your revocation declaration or the goods and for us, upon receipt of this information or the goods.

 

Right of revocation Europe

 

For customers whose place of business is located in the member states of the EU – except from Finland – the following deviations are applicable: They have to pay the direct return shipment costs. For orders from Estonia, the return shipment costs of the consumer are limited to 10 €. For consumers whose place of business and delivery is Malta or Slovenia, the period of revocation is 15 days.

 

Right of revocation outside Europe

 

For customers whose place of business and delivery is located outside of the EU the right of revocation only applies if such a right of revocation or return for consumer orders is mandatory according to the law of the state where the customer resides. Otherwise, you have to pay the direct return expenses.

4.2 Please return the goods as stamped package and keep the mailing receipt. Please let us know your bank details so that we can refund the postal charges incurred.

4.3 Please inform us prior to your return shipment by email or phone that you intend to return the goods. This helps us with allocating the products as fast as possible.

 

5. Prices and shipping costs

 

5.1 The prices stated on the product pages include VAT and other price components for deliveries within the European Union.

5.2. Applicable customs duties and/or taxes for deliveries to countries outside of the European Union are not included in the prices and added to the prices stated. Please ask for the current conditions of import at the customs office in your country.

5.3 All prices are including shipping costs.

 

6. Delivery

 

6.1 Delivery within Germany is made by DHL, for deliveries to foreign countries we reserve the right to assign another service provider.

6.2 The delivery times stated in the online shop relate to the time of delivery of the goods to the assigned service provider. The term of shipping is added to this period of time and is usually 3 days within Germany and up to 3 weeks to foreign countries.

 

7. Payment

 

7.1 We only accept payment in advance, currency is Euro.

7.2 In the event you choose the payment method „bank transfer“, we will provide our bank details in the order confirmation and the goods will be delivered after receipt of payment. In case of foreign bank transfer, all fees incurred (exchange rate, transaction) are at your expense. Delivery will only be made when the total invoice amount has been credited to our bank account.

7.3 If you have chosen „Paypal“ or „Skrill“ as payment method, the terms and conditions of the respective payment service provider apply.

7.4 The customer is only entitled to a right of set-off or retention provided that his counter claims have been judicially determined, or are uncontested or acknowledged by us.

7.5 You can exercise a right of retention only as far as it is a matter of claims resulting from the same contractual relationship.

 

8. Warranty

 

In the event that a delivered article displays evidence of material or manufacturing defects, including possible transport damage, please report such problems immediately to Audictive. However, even if you neglect to make such complaint, your legal rights remain unaffected. For any other defects arising within the legal period of warranty, the legal demands for re-fulfillment, correction of defects or additional deliveries can be applied according to the consumer's choice, or - when the particular legal conditions are given - the more far-reaching claims to depreciation and withdrawal, or to indemnification, including the compensation of the damage as well as the compensation for wasted efforts.

When you have found the desired product(s), you can place these item(s) into your shopping cart by clicking on the button „Place in Shopping Cart”. You can view the contents of your shopping cart without obligation at any time by clicking the link „Shopping Cart”. You can delete the contents of your shopping cart by clicking the trashcan icon at any time. If you want to buy the products in the shopping cart, please follow the procedure by clicking „Order Shopping Cart “. In this case, please enter your personal data. Obligatory fields are marked with an *. You do not need to register but it allows you a convenient administration of your order and simplifies further orders. Once your data has been entered and when you have selected the payment method, you will reach the order page, on which you can check your entries again.

If you have selected another payment method, please follow the instructions of the respective company. The process can be cancelled at all times by closing the browser window. The order data will be sent to you via email and our GTC will be provided with the ordered goods. If you have created a user account, you can view your order data on our website.
